• To the fullest extent permitted by law, ClinicalHawk shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Services.

• Our total liability for any claim shall not exceed the amount paid (if any) by you to use the Services.

• You agree to indemnify, defend, and hold harmless ClinicalHawk, its directors, employees, and affiliates from any claims, damages, liabilities, or expenses resulting from your misuse of the Services or violation of these Terms.

11. Termination

• Upon termination, your right to use the Services will immediately cease.

12. Governing Law & Dispute Resolution

• These Terms are governed by the laws of India.

• Any disputes shall first be attempted to be resolved amicably. If unresolved, disputes will be subject to the exclusive jurisdiction of the courts located in Ahmedabad, India.

• The “Last Updated” date will reflect the most recent revision.

• Continued use of the Services after updates constitutes acceptance of the revised Terms.

7. Clinical Use Disclaimer

• ClinicalHawk provides software solutions and tools for clinical trial management and related processes.

• Our Services do not provide medical advice, diagnosis, or treatment.

• Clinical decisions and trial outcomes remain the sole responsibility of sponsors, CROs, investigators, and other authorized users.

• ClinicalHawk is not liable for:

  • Errors, omissions, or inaccuracies in clinical trial data entered by users.

  • Adverse events, regulatory issues, or trial failures resulting from the use of our Services.

  • Any interpretation of system outputs as medical or scientific advice.

• Users must ensure compliance with applicable regulatory requirements (FDA, EMA, ICH-GCP, CDSCO, or others) when using our Services.
